Welcome to CrosCrow. These Terms & Conditions ("Terms") govern your access to and use of the CrosCrow website, products, and services. By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, please refrain from using our services.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India.

1. About CrosCrow

CrosCrow is a curated online marketplace that connects customers with independent and homegrown fashion brands across India. Products listed on the platform are sold and fulfilled by our partner brands, while CrosCrow facilitates product discovery, order management, payment processing, customer support, and related marketplace services.

2. Eligibility

By using our platform, you confirm that:

You are at least 18 years of age or are using the platform under the supervision of a parent or legal guardian.
The information provided by you is accurate, complete, and up to date.
You will use the platform only for lawful purposes.

3. User Account

You are responsible for maintaining the confidentiality of your account credentials.

You agree to:

Provide accurate registration information.
Keep your login credentials secure.
Notify us immediately of any unauthorized use of your account.

CrosCrow reserves the right to suspend or terminate accounts involved in fraudulent, abusive, or unlawful activities.

4. Products & Availability

Products displayed on CrosCrow are offered by independent partner brands.

While we strive to ensure product accuracy:

Product images are for representation purposes only.
Actual colors may vary depending on screen settings.
Product availability is subject to stock with the respective brand.
We reserve the right to modify, discontinue, or remove products without prior notice.

5. Pricing

All prices displayed are in Indian Rupees (INR) unless stated otherwise.

Although we make every effort to ensure pricing accuracy, CrosCrow reserves the right to correct pricing errors and cancel orders affected by technical or pricing mistakes.

6. Order Acceptance

Placing an order does not constitute final acceptance.

An order may be cancelled or declined if:

The product is unavailable.
Payment cannot be verified.
Fraudulent activity is suspected.
Incorrect pricing or technical errors occur.
Delivery is not serviceable.

Customers will be notified if an order cannot be fulfilled.

7. ₹99 COD Confirmation

To reduce fake and unverified Cash on Delivery (COD) orders, certain COD orders require a non-refundable ₹99 advance confirmation payment before dispatch.

This amount is adjusted against your total order value.
Orders that are not confirmed within the specified timeframe may be cancelled automatically.
If CrosCrow or the partner brand cancels the order before shipment, the ₹99 confirmation amount will be refunded.
If the customer cancels after confirmation or refuses delivery without an eligible reason under our policies, the ₹99 confirmation amount may not be refunded.

8. Payments

We accept multiple payment methods through secure payment gateways.

By placing an order, you authorize CrosCrow and its payment partners to process the transaction.

Payment processing is handled by trusted third-party payment service providers.

9. Shipping & Delivery

Orders are shipped directly by partner brands.

Estimated delivery timelines are provided for convenience only and are not guaranteed.

Delivery may be delayed due to circumstances beyond our control, including courier disruptions, weather conditions, public holidays, or operational issues.

10. Cancellations, Returns & Refunds

Order cancellations, returns, exchanges, and refunds are governed by our Returns & Refund Policy.

Certain items may not be eligible for return or exchange due to hygiene, customization, or brand-specific restrictions.

Refunds, where applicable, will be processed according to our published policy.

11. Marketplace Responsibility

CrosCrow acts as a marketplace platform connecting customers with partner brands.

While we facilitate transactions and customer support, manufacturing, product quality, inventory, packaging, and dispatch are primarily the responsibility of the respective partner brand.

However, CrosCrow will make reasonable efforts to help resolve customer concerns.

12. Intellectual Property

All website content, including logos, graphics, images, designs, software, text, and trademarks, is owned by CrosCrow or its respective licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or commercially exploit any content without prior written permission.

13. Prohibited Use

You agree not to:

Violate any applicable law.
Attempt unauthorized access to our systems.
Use bots or automated tools without permission.
Disrupt website functionality.
Post false, misleading, or abusive content.
Engage in fraudulent purchases or payment activities.

Violation of these Terms may result in account suspension or legal action.

14. Limitation of Liability

To the maximum extent permitted by law, CrosCrow shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our platform.

Our total liability, if any, shall not exceed the amount paid by the customer for the relevant order.

15. Force Majeure

CrosCrow shall not be liable for delays or failures resulting from events beyond reasonable control, including natural disasters, strikes, pandemics, government restrictions, transportation disruptions, cyber incidents, or other unforeseen circumstances.

16. Privacy

Your use of CrosCrow is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your information.

17. Changes to These Terms

CrosCrow reserves the right to update or modify these Terms at any time.

Revised Terms become effective immediately upon publication on this website.

Continued use of the platform after such changes constitutes acceptance of the updated Terms.

18. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts having jurisdiction over CrosCrow's registered place of business.
